These Terms of Service govern your use of this website and any purchase you make from Avida Wellness ("we", "us", "our"). By browsing this site or placing an order, you agree to these terms. If you do not agree, please do not use the site.

We sell dietary supplements. Please read this section carefully.

If a product is listed at an incorrect price, we may cancel the order and refund you in full, even after the order is confirmed.

Your order is an offer to buy. We may accept or decline it. We may refuse or cancel any order, including where we suspect fraud, resale, or a pricing error. Payment is taken when the order is placed. You are responsible for any applicable taxes.

You warrant that any payment method you use is yours and that you are authorized to use it.

5. Subscriptions and Recurring Charges

If you enroll in a subscription or refill plan, you authorize us to charge your payment method on a recurring basis until you cancel. Full terms, including renewal reminders, change deadlines, and how to cancel, are set out in our Subscription Policy, which forms part of these terms.

6. Shipping, Title, and Risk

Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery to the carrier. We are not liable for carrier delays. Damaged or lost shipments are handled under our Refund & Return Policy.

7. Returns

Returns and refunds are governed by our Refund & Return Policy, which forms part of these terms.

8. Acceptable Use

You agree not to use this site to break any law, infringe anyone's rights, transmit malicious code, scrape or harvest data, interfere with the site's operation or security, impersonate anyone, or resell our products without written permission.

9. Intellectual Property

All content on this site — text, images, logos, product photography, graphics, and design — is owned by Avida Wellness or our licensors and is protected by intellectual property law. You may not copy, reproduce, republish, or use it commercially without our written permission.

10. User Submissions

If you submit a review, photo, comment, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it in connection with our business. You confirm the content is yours to give and is not unlawful. We may remove any submission at our discretion.

This site may link to or use third-party services. We do not control them and are not responsible for their content, products, or privacy practices. Your dealings with them are between you and them.

12. Disclaimer of Warranties

The site and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, Avida Wellness and its officers, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the site or any product. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

14. Indemnity

You agree to indemnify and hold harmless Avida Wellness from any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or third-party right.

15. Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida.

16. Changes to These Terms

We may update these terms at any time. The version posted here is the version in effect. Continuing to use the site after a change means you accept the revised terms. Material changes to subscription terms will be notified as described in our Subscription Policy.

17. Severability and Entire Agreement

If any provision is found unenforceable, the rest remain in effect. These terms, together with our policies referenced above, are the entire agreement between you and us regarding the site and your purchases.
